Small Claims Court Montgomery County 38-1-03 Magisterial District Court

In Pennsylvania, Magisterial District Judges (“MDJs”) decide small claims cases. Small claims cases involve civil disputes where the claim is for twelve thousand ($12,000.00) dollars or less. If the party filing the lawsuit, also known as the plaintiff, is seeking a claim for over twelve thousand ($12,000.00) dollars, the plaintiff may either file with the Pennsylvania Court of Common Pleas or file in the small claims court with the Magisterial District Court. However, if a plaintiff chooses to file with the Magisterial District Court, the plaintiff waives their right to recover any amount over twelve thousand ($12,000.00) dollars.
Pennsylvania small claims courts have jurisdiction to adjudicate certain civil claims, including contract disputes, personal injury, property damage, and other negligence cases.
