How Pennsylvania Handles DUI Cases


Pennsylvania DUI statute 75 PaCSA 3802 - Driving Under the Influence, criminalizes driving or operating a vehicle on a roadway in Pennsylvania where the driver is under the influence of drugs or alcohol that renders an individual incapable of operating a motor vehicle. Note, there is no "impairment" requirement for schedule one controlled substances, including Medical Marijuana - even if you have a valid medical card.


 Pennsylvania uses a tiered system for DUI charges based on Blood Alcohol Content (BAC) or any amount of a controlled substance:


  • General Impairment (.08 – .099%)


  • High BAC (.10 – .159%)


  • Highest BAC (.16% and above)


Drug DUIs — including marijuana — are prosecuted harshly, often in the “highest tier,” even for medical marijuana patients.

The penalties vary depending on your BAC and prior record, but can include:

  • License suspension
  • Thousands in fines
  • Jail time or probation
  • Mandatory alcohol highway safety school
  • Ignition Interlcok
